Terms of Service

1. General

CosmoDEV SPA ("we", "us", "our") operates Selenia. Our registered address is Zenteno 2707, 35A, Osorno, LL, 5290000, Chile.

By creating an account or using the app you agree to be bound by these Terms of Service. If you do not agree, you may not use the application. We reserve the right to update these Terms at any time by posting the revised version in the app or on this page. Continued use after changes are posted constitutes acceptance of the updated Terms.

2. Description of the service

Selenia is a menstrual cycle tracking application. It records your health data to show you cycle predictions, fertile window, and personal statistics. Features and content may be modified, added, or removed at any time without prior notice.

Selenia is not a medical service. The information it provides is for guidance only and does not replace the diagnosis or advice of a healthcare professional.

3. Your account

Selenia is designed for anyone who menstruates, including adolescents. You must be at least 13 years of age to create an account, in line with standard data protection requirements.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering and keep it up to date. Notify us immediately of any unauthorized use of your account.

4. Acceptable use

You may not:

• Use the app for any illegal or unauthorized purpose.

• Attempt to access other users' data or accounts.

• Interfere with or disrupt the operation of the service.

• Transmit any virus, worm, malware, or destructive code.

• Harvest or collect personal data of other users.

• Engage in spam, phishing, or any other deceptive or fraudulent practice.

• Violate any applicable local, national, or international law or regulation.

5. Subscription and billing

Selenia offers three subscription plans: Monthly ($3.99), 6-month ($17.99), and Annual ($27.99), billed automatically at the start of each period. Your first cycle is free — a payment method is required at sign-up but no charge is made until the trial ends. Cancel before it ends and you won't be charged.

Prices are subject to change. We will notify you of any price change before it takes effect, giving you the opportunity to cancel before being charged at the new rate. We reserve the right to refuse, limit, or cancel subscriptions at our discretion.

You agree to provide current, complete, and accurate billing information. For cancellations and refunds, see our Refund Policy at selenia.app/refund.

6. Intellectual property

The design, code, and content of Selenia are the property of CosmoDEV SPA and its developers. The data you enter belongs exclusively to you — we have no rights over it except as necessary to provide the service.

7. Privacy and personal data

Your use of Selenia is also governed by our Privacy Policy, available at selenia.app/privacy. By using the app you consent to the processing of your data as described therein.

8. Limitation of liability

Selenia is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, error-free operation, or the accuracy of cycle predictions.

To the fullest extent permitted by applicable law, CosmoDEV SPA, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages — including loss of data, loss of revenue, or any decisions made based on information provided by the app — arising from your use or inability to use the service. Where applicable law does not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted.

9. Indemnification

You agree to indemnify, defend, and hold harmless CosmoDEV SPA and its officers, directors, employees, and agents from any claim, demand, or expense (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your infringement of any third-party rights.

10. Termination

You may stop using Selenia and delete your account at any time from Settings → Account → Delete account.

We may suspend or terminate your access immediately and without notice if you breach any provision of these Terms or if we determine that your use poses a risk to the service or other users. Obligations incurred before termination remain in effect. Upon termination, your data will be handled as described in our Privacy Policy.

11. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

12. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Chile. Any dispute arising from these Terms shall be submitted to the competent courts of Santiago, Chile.

13. Modifications

We may update these Terms at any time. If the changes are material, we will notify you inside the app at least 15 days before they take effect. Continued use of the service after that date constitutes acceptance of the revised Terms.
